Here's some clarification. I am not an expert but this is what I've learned about US copyright recently.

• Using 10% (or less) of a work falls under fair use.
• Parts of a published product cannot be copyrighted, only the final product (aka the game not the art).

trying to summarize copyright is pretty much impossible. I what I wrote isn't untrue but is was perhaps too abbreviated to be of much help, which is why I had the disclaimer about not being an expert. There is a fine line between art and fair use/reuse, so when in doubt, the ask a lawyer.
